Terms of use

1.1. The terms of use of the e-store (hereinafter “Terms”) apply to all legal relationships, sales transactions, orders, offers that take place between the user of the e-store (hereinafter “customer”) and the owner of the e-store newrustic.ee (hereinafter “e-store”). OÜ (hereinafter “online store”), registry code: 12718793. 

1.2. In addition to the conditions, the legal relations arising in the course of using the e-store are regulated by the legislation of the Republic of Estonia. 

1.3 The Online Store may change the terms at any time. Changes to the Terms will be published on newrustic.ee and will take effect immediately upon publication. By using the e-shop and placing an order through it, the customer confirms that he has agreed to the terms. 


2. Prices  

2.1 Prices in the e-shop are given in euros (marked with the symbol “€”). 

2.2 Prices include shipping costs for shipping within the Republic of Estonia. Outside the Republic of Estonia, the customer pays the shipping cost according to the price list established by Omniva.

2.3 If the Customer orders the product outside the European Union, the product may be subject to import obligations and customs duties, which will be paid upon arrival of the product in the country of destination. Such taxes are paid by the customer. Tax and customs policies may vary by country, so the online store advises the customer to review any additional taxes before ordering the product. 

2.4 The online store may change the prices displayed in the e-store at any time. All changes will be published on the website newrustic.ee and will take effect from the moment of publication. 

2.5 If the customer's order is submitted before the price change is published, the price valid at the time of purchase is applied to the customer.

 
3. Ordering and payment terms
 

3.1 To place an order, select the appropriate product from the online store and click the "add to cart" button. By clicking the "make a purchase" button, you can view the products in the shopping cart, change the quantities and remove them. The purchase amount is also visible on the same page. 

3.2 When placing an order, the customer is obliged to enter his / her details: name, e-mail address, company (if the invoice is issued to the company), shipping address and telephone. In addition, delivery notes can be added if desired (e.g. preferred location for a parcel machine). The customer is obliged to check the payment and delivery information, because the speed and worry-free delivery of the product depends on the information provided by the customer. 

3.3 It is possible to pay for the product using the bank links, credit card or pay via Paypal in the e-shop ordering environment. The customer pays for the purchase 100% by confirming the order. 

3.4 The Agreement is concluded from the moment when the payment reaches the current account of the online store, if the customer sends a screenshot confirming the payment order confirmed by the bank to the e-mail kristi@newrustic.ee. 


4. Product delivery  

4.1 The online store delivers the product to the customer by post or parcel machine. The online store notifies the customer by e-mail when the product has been launched or may be picked up, and also sends the parcel tracking code, if available.

4.2 Delivery of the product by post usually takes 7-9 days in European countries and up to 21 days in other parts of the world. It takes 1-3 days to send by parcel machine. If the product has not arrived by then, inform the e-mail kristi@newrustic.ee. The online store is not responsible for delays or problems caused by the inaccuracy of the data entered by the customer when placing an order.  

 

5. Product return

5.1. Pursuant to the Consumer Protection Act of the Republic of Estonia, the customer has 14 days to receive the product after receiving it. If the customer is not satisfied with the product for any reason, the customer has the right to return the product within 14 days by notifying the online store at the e-mail address kristi@newrustic.ee. 

5.2 The returned product must be in the original packaging and with all labels attached to the product. The customer must ensure that the returned product is unused and in the same condition as when it was sent to the customer. Products returned with traces of use will not be accepted by the online store and will be returned to the customer. 

5.3 If the customer returns the product in accordance with the terms of clauses 5.1 and 5.2, the online store will refund the cost of the product to the customer (shipping costs will be borne by the customer). The cost of the product will be returned to the customer no later than within 14 days from the moment the customer has submitted the return application to the online store, provided that the returned product itself reaches the online store within that time (ie 14 days).    

5.4 If the product has defects, the customer is obliged to contact the online store as soon as possible in order to submit a corresponding application. The online store will replace the product or, if this is not possible, will refund the cost of the product. If the product is defective, the costs of replacing the product will be borne by the online store. Pursuant to the Consumer Protection Act of the Republic of Estonia, a consumer customer has the right to submit claims for 2 years from the time of making the purchase. 

5.5 The online store reserves the right to terminate the contract if the product ordered by the customer cannot be produced or if the product was ordered at the time when the typographical error occurred in the e-store regarding the price of the product. If the contract is terminated, the customer will be notified by e-mail and the money will be refunded to the customer as soon as possible, but no later than within 30 days of ordering the product.

 

6. Use and protection of personal data  

6.1 The customer consents to the online store processing his personal data.

The data entered by the customer when submitting the order is stored by the online store for the purpose of fulfilling the order of the product submitted by the customer and developing the service offered to the customer by the online store. 

6.2 The personal data to be registered includes data on the customer's order - customer's name, company name (if applicable), address, e-mail address, telephone number, payment method used and data on the selected product (incl. Quantities). 

6.3 The online store may transmit the customer's personal data, which is necessary for the delivery of the product to the company providing the courier service. 

6.4 The protection of personal data is guaranteed by all security measures arising from the law of the Republic of Estonia.

The online store does not transfer registered personal data to third parties, except in cases prescribed by law of the Republic of Estonia. 
 
 

7. Liability and force majeure  

7.1 The parties shall be released from the performance of the obligations arising from and related to the contract in part or in full, if this is prevented by force majeure, and the parties are obliged to take all measures to prevent damage to the other party and ensure the performance of the contract as much as possible. Force majeure must be proved by the party who wishes to invoke these circumstances as a basis for releasing the liability arising from the law and / or the contract for non-performance or improper performance of the obligations assumed under the contract. Force majeure within the meaning of the contract is not a change in the economic situation of a party, bad weather, a rise in prices, a holiday, bankruptcy, or a warning of bankruptcy or securing an action. 

7.2 All liability of the online store is limited to the cost of the product. 

7.3 Links to other websites from the Online Store are not under the control of the Online Store and the Online Store shall not be liable for any damages that may arise in connection with the use of such links.

 
8. Applicable law
 

8.1 The law of the Republic of Estonia shall apply to the Terms and Conditions. 

8.2 All disputes between the customer and the online store will be resolved through negotiations. If a compromise is not reached, the customer has the right to apply to the Consumer Protection Board or Harju County Court.
